Terms of Service

These Terms of Service ("Terms") govern your use of the Plyst mobile application and website at plyst.app (collectively, the "Service"), operated by Plyst ("we", "our", or "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Plyst is a tool for live, in-person musical performances. It has two types of users:

• Performers — musicians who create an account to manage a song catalog, run events, take live song requests, and receive tips.
• Audience members — people at a live event who scan a QR code to request songs or tip the performer. Audience members do not create accounts.

2. Eligibility & Accounts

You must be at least 18 years old to create a performer account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date.

3. Subscriptions & Billing

Certain features require a paid subscription ("Plyst Pro"), offered as an auto-renewable subscription on a monthly or annual basis.

• Purchases through the App Store: when you subscribe through the iOS app, payment is charged to your Apple ID and billing is handled by Apple. These purchases are also governed by Apple's standard Licensed Application End User License Agreement (EULA).
• Auto-renewal: your subscription renews automatically at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Managing and canceling: you can manage or cancel your subscription at any time in your App Store account settings. Cancellation takes effect at the end of the current billing period. Deleting your Plyst account does not automatically cancel an App Store subscription — you must cancel it separately through Apple.
• Refunds: subscription refunds are handled by Apple in accordance with the App Store's policies.

4. Tips & Payouts

Tips are voluntary payments made by an audience member to a performer for a live, in-person musical performance. Tips are a real-world, person-to-person gratuity — like placing money in a tip jar at a show — and are not payment for any digital content or service delivered through the Service.

• Plyst is not a party to tips. We provide the tools that let an audience member send a tip and a performer receive it. The tip itself is a transaction between the audience member and the performer.
• Payment processing: tips and payouts are processed by Stripe. To receive tips, a performer must set up a Stripe account and complete Stripe's identity verification. Use of Stripe is subject to the Stripe Connected Account Agreement.
• Taxes: performers are solely responsible for reporting and paying any taxes owed on tips they receive.
• No guarantee: we do not guarantee any amount of tips and are not responsible for chargebacks, disputes, or failed payouts, which are governed by Stripe's terms.

5. Your Content

You retain ownership of the content you add to the Service, including song details, notes, and chord charts ("Your Content"). You grant us a limited license to store, process, and display Your Content solely to operate the Service for you.

You are responsible for ensuring you have the rights to any content you upload, and for your use of any chord charts or lyrics. Plyst may use third-party and AI-assisted tools to help generate or import chord charts; you are responsible for verifying the accuracy and permitted use of the results.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to infringe the rights of others;
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service;
• Use the Service to send spam, harassing, or abusive content;
• Misrepresent your identity or use the tipping features for fraudulent purposes.

We may suspend or terminate accounts that violate these Terms.

7. Third-Party Services

The Service relies on third parties including Apple, Stripe, and Supabase. Your use of those services through Plyst is subject to their respective terms. We are not responsible for the acts or omissions of third-party providers.

8. Termination & Account Deletion

You may delete your account at any time from within the app (Settings → Delete account) or by contacting us. Deleting your account permanently removes your account and associated data as described in our Privacy Policy. We may suspend or terminate your access if you violate these Terms.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Plyst will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. We will notify performers of material changes via email or an in-app notice. The "last updated" date above reflects the most recent version. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
